Terms of Service

Please read these terms carefully before using Spearpay's services.

1. Acceptance of Terms

By accessing or using Spearpay's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the modified terms.

2. Eligibility

To use Spearpay, you must:

  • Be at least 18 years of age
  • Be a legal resident of a country where our services are available
  • Have a valid government-issued identification
  • Have a valid bank account or payment method
  • Not be on any government sanctions lists
  • Provide accurate and complete registration information

3. Account Registration

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4. Money Transfer Services

4.1 Transaction Limits

Transfers are subject to daily, weekly, and monthly limits based on your verification level and applicable regulations. Current limits are displayed in your account dashboard.

4.2 Exchange Rates

Exchange rates are displayed at the time of transaction and are locked when you confirm your transfer. Rates may vary based on market conditions.

4.3 Fees

All applicable fees are disclosed before you confirm a transaction. We do not charge hidden fees. Third-party fees from banks or mobile money providers may apply.

4.4 Processing Time

Most transfers to mobile money wallets are completed within minutes. Bank transfers may take 1-3 business days. Delays may occur due to verification requirements or issues with recipient information.

4.5 Service Availability (US-only)

Spearpay currently serves users located in the United States only. Corridor availability may vary by state and by partner banks/mobile-money providers. We may decline or pause a transaction to comply with law, sanctions, fraud, or risk controls.

5. Prohibited Activities

You agree not to use Spearpay for:

  • Money laundering or terrorist financing
  • Fraud or any illegal activities
  • Transactions involving illegal goods or services
  • Circumventing transaction limits or verification requirements
  • Creating multiple accounts for fraudulent purposes
  • Interfering with our systems or security measures
  • Violating any applicable laws or regulations

6. Cancellations and Refunds

You may cancel a transfer before it has been processed. Once funds have been disbursed to the recipient, the transaction cannot be cancelled.

Refunds for failed or reversed transactions are processed back to your original payment method. We generally issue refunds within 5–10 business days after confirmation of failure; timing can vary based on payment method and your bank.

Error resolution: if you report a transfer issue, we will investigate promptly. Where required by law (e.g., consumer electronic funds rules), we may provide provisional credit while we investigate. Some fees may be non-refundable unless the issue was caused by us or required by law.

7. Account Suspension and Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms of Service
  • We suspect fraudulent or illegal activity
  • Required by law or regulatory authorities
  • You provide false or misleading information
  • Your account remains inactive for an extended period

You agree to cooperate with our KYC, AML, and sanctions screening requests, including providing accurate information and documentation. We may hold, delay, or reverse transactions to comply with law or mitigate fraud and abuse.

8. Limitation of Liability

To the maximum extent permitted by law, Spearpay shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Delays or failures caused by third parties
  • Unauthorized access due to your negligence
  • Force majeure events beyond our control

Our total liability for any claim arising out of or relating to the services is limited to the greater of (a) the fees you paid to us for the transaction giving rise to the claim in the three months before the event, or (b) $200. This cap does not apply to liability that cannot be limited under applicable law or to our gross negligence or willful misconduct.

9. Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through:

  1. Good faith negotiation between the parties
  2. Mediation by a mutually agreed mediator
  3. Binding arbitration on an individual basis under the AAA Consumer Rules in Los Angeles County, California, unless you and we agree otherwise

You waive any right to participate in class or representative actions. Either party may pursue an individual claim in small claims court in the county of your residence or our principal place of business. You may opt out of arbitration within 30 days of accepting these terms by notifying us through our website contact channel.

10. Governing Law

These Terms of Service are governed by the laws of the State of California, United States, without regard to conflict of law rules. Mandatory consumer protection laws of your state of residence may also apply.
